RUSSIAN IDSF MEMBER LOSES COURT ACTIONS.

Our member for Russia , the RDU has infomed us of several court cases that have been conducted in recent months and asked us to publish the following information:


The Dancesport Federation of Russia (DSFR) have in recent years lost a number of court actions brought against them with regard to their policy on bans of Amateur Dancers.

The most recent incidents are reported as follows :

August, 2010.
A lawsuit filed by the Russian Dance Union Lawyer Mr. Semen Vishnevsky on behalf of 6 dancers Vassily Kirin & Ekaterina Prozorova, Vladimir Litvinov & Alexandra Akimova , Andrey and Anna Ivanov and 2 adjudicators Lev and Svetlana Pjankov’s saw the DSFR Rules banning their participation in all tournaments in Russia and abroad declared Illegal.

In addition compensation was awarded for moral injury.

December, 2010.
Four suits were brought on behalf of Lev and Svetlana Pjankov's and Vladimir Litvinov and Alexandra Akimove and the DSFR actions were declared illegal
and orders prohibiting participation in competitions in Russia and abroad were quashed

February, 2011
In Khamovnichesky Court in Moscow hearings were held and again the actions of the Dancesport Federation of Russia against the dancers Vassily Kirin & Ekaterina Prozorova and Andrey & Anna Ivanov were declared illegal and the Court awarded damages for Moral Harm of 3000 Rubles to each dancer.

It is regrettable that in the world of competitive dance today dancers and adjudicators undergo threats and stress and need to bring court action to protect their basic rights .

Let us hope that in the future the Dancesport Federation of Russia will observe the law as established in these latest cases.

swinganddance möchte ergänzen, dass wir die gleiche Situation in Italien vorgefunden haben.

Auch in der Schweiz ist die Situation NICHT anders.

wie swinganddance schon früher publizierte, war Hr. W. Varisco, Präsident des STSV, schlecht beraten seinen offenen Brief zu publizieren. Es war voreilig.

Wie wir ja von der CONI [Comitato Olimpico Nazionale Italiano: l'organizzazione che cura lo sviluppo e la promozione dello sport in Italia.] wissen, ist eine Untersuchung eingeleitet worden.
Das Ergebnis ist noch nicht bekannt, aber schon alleine die Tatsache, daß ein Nationales Olympisches Komitee eine Untersuchung einleitet, die Tänzer im Vorfeld sich gegen FIDS entschieden haben, spricht Bände.

Für den IDSF generell bedeutet es, SIE SIND EINKLAGBAR und man kann vor Gericht gewinnen. Es werden Strafen verhängt. In den Niederlanden haben 2008 die Tänzer vor Gericht bereits gewonnen.

Dem STSV wird dringend geraten "über die Bücher zu gehen" und sich von seinen menschenunwürdigen, illegalen Praktiken zu verabschieden.

Repression hat sich noch nie ausbezahlt. Die Quittung kommt immer. Früher oder später.
